|To enter the ArcLight Documentary Festival, participants must submit a trailer, 2 minutes maximum in length, as well as the full-length film. Films must have a run time between 10 and 120 minutes. Shorts may not be over 30 minutes in length. Foreign films must have English subtitles. Films submitted must have been completed no earlier than January 1, 2012. The winning documentary will be determined by a panel of five judges based on creativity, cinematography, editing and story line.
MISSION & OBJECTIVE
This is the third-annual ArcLight Cinemas Documentary Film Festival, which offers talented, independent filmmakers a chance to share their work with fellow film-enthusiasts and gain exposure within the entertainment industy.
The festival will take place at ArcLight Hollywood from October 9th-13th. Each night will feature 4-5 of the 25 films, shorts being shown together in one feature. 5 of the 25 films will be “fan picks” that will be chosen by viewers on YouTube and Facebook. ArcLight will host a special reception on October 13th to announce the winning documentary and present its producer with $10,000.

How to Enter
1. Submit an application on Withoutabox.com (no cost).

3. The email must include your full name, email address, phone number, and a brief synopsis of your film.
- Submissions will be reviewed and judged by festival personnel. Up to 10 films, as determined by festival personnel in their sole discretion, will be posted on the festival YouTube channel, Facebook page, contest website or other page.
- For three weeks, viewers vote on their favorite trailers on Facebook (once per account) and “Like” their favorite trailers on YouTube.
- The 5 trailers with the most votes/”likes” (per category) will earn a place in the festival.
- A panel of judges will choose the winning documentary based on creativity, cinematography, editing and story.
- The winning documentary will win a $10,000 cash prize.

The ArcLight Independent Documentary Film Festival (“Festival”) Contest (the “Contest”) is sponsored by Pacific Theaters Exhibition Corp. d/b/a ArcLight Cinemas, 120 N. Robertson Blvd., Los Angeles, CA 90048 ("ArcLight" or “Sponsor”). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, you agree to abide by these Official Rules, including all eligibility requirements, and understand that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
The Contest is open to individuals18 years of age and older, or 16 years of age and older with proof of emancipation. In order to submit an entry or be awarded a prize, emancipated minors over the age of 16 must provide documentation to prove legal emancipation and will be required to complete and sign the necessary affidavit of eligibility and publicity release form. [SUBJECT TO CONFIRMATION BY ARCLIGHT] Employees, officers and directors of ArcLight and its respective parents, subsidiaries, agents and suppliers, including, without limitation, Mission Control Group and Withoutabox, a DBA of IMDB.com, Inc., as well as members of their immediate families (defined as parents, spouses, children, siblings and grandparents) and individuals living in the same household as those individuals are not eligible to enter or win. Sponsor has the right to verify the eligibility of each entrant.
The Contest begins on January 1, 2013.
Submissions (as defined below) will be accepted from January 1, 2013 to 11:59pm on May 31, 2013
(“Submission Period”). Entries must be received by the end of the Submission Period to be eligible.
Public voting (as described below) will take place on June 17, 2013 until 11:59pm p.m. on July 21, 2013 (“Voting Period”).
Judging of Submissions which advance to the judging round after the Voting Period will take place between August 14, 2013 and October 11, 2013 (“Judging Period”).
HOW TO ENTER
To enter the Contest, submit the following items to ArcLight:
1. Complete An Entry Form: Access the Contest website available at www.withoutabox.com (the “Contest Website”) and follow the links and instructions provided to complete an entry form. You must complete the online entry form in full by providing your name, telephone number, e-mail address, and any other requested information. Your use of the Contest Website is subject to terms and conditions set by Withoutabox. Please review the terms and conditions governing use of the Contest Website before entering the Contest. Please note: Withoutabox’s terms and conditions and privacy policies govern your provision of information to Withoutabox and its uses of that information (as further described below in the Privacy section of these Official Rules)
2. Submit A Documentary Film Submission Responding to the Contest Theme: The Contest is a documentary film festival. To enter, you must submit a trailer for a full length documentary film in the Categories as described below (collectively a “Submission”). All Submissions must adhere to all requirements set forth in these Official Rules and on the Contest Website for Submissions. Submit your completed Submission, which adheres to all applicable requirements, via the Contest Website according to the instructions provided on the Contest Website. Additional Submission requirements are set forth below. Only online entries submitted through the Contest Website in accordance with these Official Rules will be accepted. No photocopied, mechanically reproduced, telephoned, faxed, emailed or mailed applications will be accepted otherwise.
There is no limit on the number of Submissions you may enter in this Contest. Receipt of entry will not be acknowledged, and proof of submission of an entry will not be deemed proof of receipt. Any automated computer submission response (such as a “thanks for entering” message) does not constitute proof of actual receipt of entry by Sponsor. Sponsor has no obligation to advise you of an incomplete or otherwise non-compliant entry. Sponsor is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected entries, which will be disqualified. Proof of submission of an entry will not be deemed proof of receipt. In the event of a dispute as to any entry, the authorized account holder of the email account used to enter will be deemed to be the entrant. The “authorized account” holder is the natural person assigned the email account by the email service provider. Potential winners may be required to show proof of being the authorized account holder.
PLEASE READ THE FOLLOWING REQUIREMENTS CAREFULLY. SUBMISSIONS WHICH DO NOT COMPLY WITH THESE REQUIREMENTS MAY BE DISQUALIFIED OR NOT FULLY CONSIDERED.
There are five (5) Submissions categories (each a “Category” and collectively the “Categories”):

ADDITIONAL SUBMISSION REQUIREMENTS
Each Submission must include one (1) trailer for its respected full length documentary film.
Each documentary film included in a Submission must be between 60 minutes and 120 minutes long, except for “shorts” which may be no more than 30 minutes, but no less than 10 minutes long and “foreign” which may be from 10-120 minutes long.
Trailers must be no longer than two (2) minutes.
Submissions containing significant non-English spoken dialogue must provide on-screen English subtitles.
Each Submission must be your unique, original work and may not be a duplicate of a prior Submission made by you or any other entrant.
Promotional, instructional or industrial films, and raw documentation of performances are not permitted.
Submissions must comply with the following required technical specifications:
Mail trailer to 21324 San Miguel Street, Woodland Hills, CA 91364 (as a CD/DVD or USB drive) or YouSendIt (to the email address - firstname.lastname@example.org) in High Res in a .mov format, suitable for upload by Festival Staff to YouTube. Your full length film will be requested later in the Contest.
Submissions must be factually accurate and contain no material fictional elements (other than for the purpose of illustrating factual matters).
In addition, Submissions may not contain, as determined by Sponsor, in its sole discretion, any content that:
is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group or treat any individual, organization or group with disrespect; profane or pornographic; contains nudity or is otherwise potentially offensive to a family audience;
promotes alcohol, illegal drugs, tobacco, firearms/weapons (or depicts the use of any of the foregoing); references politics or takes a political point of view;
depicts or describes any act which is dangerous or suggests any person undertake a dangerous activity, as determined by Sponsor, in its sole and absolute discretion;
appears to duplicate any other Submissions;
contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by third parties without appropriate permission;
contains any personal identification, such as license plate numbers, personal names, e-mail addresses, street addresses or telephone numbers;
contains copyright-protected materials owned by others (such as photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media) without appropriate permission;
contains materials embodying the names, likenesses, voices, or other indicia identifying celebrities or other public figures, living or dead, or images of individuals who have not granted permission;
is inappropriate, indecent, harmful, discriminatory or obscene;
could reasonably be expected to result in a third-party claim for libel, slander, defamation, invasion of privacy, infringement, authorized use or any other right of such third party, or that is the subject of any litigation or action by any governmental authority, trade union or guild or any threat thereof; or
violates any law.
If your Submission is selected for screening at the Festival, you must provide the following additional items, as requested by Sponsor:
A DVD copy of your film must be provided for judge viewing a two (2) weeks after the finalists have been announced. A projection copy of the Submissions which may be on 35 mm film, DVD, blu-ray, digital drive or hard drive at least seven (7) days prior to your scheduled screening. You are responsible for the delivery costs of shipping such copies to Sponsor, including any applicable taxes. Sponsor will only return the production copy to the entrant(s) via entrant(s) shipping account. ArcLight disavows any responsibility for and will not be liable for the shipping and handling of any such return production copies and will not provide insurance for originals or masters.

Please do not send these materials unless your Submission is selected to be screened at the Festival, as further described below. The Festival is entitled to rely on information provided in the Contest Entry Form, or otherwise by you in association with a Submission. Sponsor may, in its sole and absolute discretion, complete any information not supplied by you from whatever source available and will not be responsible for use of incorrect information.
Sponsor reserves the right, but will not be obligated, to review (or have its designee review) Submissions for compliance with these Official Rules. Sponsor has made no claims, representations or guarantees with respect to the selection of Submissions, and a Submission neither imposes nor creates any obligation or responsibility on the part of Sponsor to provide you or any other party with comments, feedback or other information pertaining to the viewing or consideration of Submissions by the voting public or by judges.
Sponsor may disqualify any Submission or remove any Submission from the Contest Website for any reason, as determined by Sponsor in its sole and absolute discretion, at any time, including, without limitation, if Submission fails to comply with any applicable website terms and conditions, these Official Rules or rules or requirements on the Contest Website.
For eligible Submissions which satisfy the Contest submission requirements, these remaining trailers submitted as part of the Submissions will be reviewed and judged by Festival personnel. Of the remaining trailers, the top seven (7) trailers, per category, as determined by festival personnel in their sole discretion, will be posted on the Festival YouTube channel, Facebook page, Contest Website or other page determined by Sponsor prior to the Voting Periods. The entrant that submitted the Submission will be notified via email that his or her trailer has been included on the Festival YouTube channel, Contest Website or other page determined by Sponsor. Sponsor will not, and will not be responsible for, notifying entrants whose Submissions are not eligible or do not otherwise satisfy Submission requirements.
Public Voting Round. During the Voting Period, the trailers for eligible Submissions will be posted on the Festival YouTube channel, Facebook page, Contest Website or other page determined by Sponsor. Selection of Submissions for screening at the Festival will be determined by vote of the viewers of the submitted trailers posted on the Festival YouTube channel, Contest Website or other page determined by Sponsor. Visitors to the Festival YouTube channel, Contest Website or other page determined by Sponsor will be able to vote on the trailers of Submissions during the Voting Period by choosing LIKE or DISLIKE using functionality provided by the applicable website. Voters may vote for more than one trailer; however, a voter may only vote for each trailer one time (i.e., a viewer may not vote for the same trailer more than once). The five (5) trailers in each Category that receive the most LIKES (“Finalists”) will be screened at the Festival and will advance to the judging round, as described below, subject to verification of the entrants’ compliance with these Official Rules and all other applicable terms and conditions.
Entrants and visitors to the Festival YouTube channel, Facebook Page, Contest Website or other page determined by Sponsor may not use any robot, spider, or other automatic device, to vote in the Contest and may not use any device, software or routine to interfere or attempt to interfere with the proper working of the voting for the Contest. Sponsor is not responsible for the accurate tallying or calculation of views or votes in the Contest.
Judging Round. The Finalists in each Category will advance to the judging round and will be evaluated and judged by a panel of judges selected by Sponsor in its sole discretion, comprised of producers, directors and other industry professionals. The panel of judges will select from among the Finalists one potential “Best in Category” prize winner in each Category and one overall Festival prize winner based on the following judging criteria: 25% on directing, 25% on cinematography, 25% on story, and 25% on editing.
In the event of a tie, the judging panel will judge the tied entries again until a winner is determined. All decisions of the judging panel are final and binding in all respects.
The potential prizewinners will be announced at a gala event on October 19, 2013 and notified in person (if attending the gala event) or by phone or email after the gala event. The data of the gala event is subject to change in Sponsor’s sole discretion without further notice. If a potential prize winner fails to claim their prize, or cannot be reached by Sponsor (or its designee) within ten (10) days of the gala event, or if prize notification (if applicable) is returned as undeliverable, that potential prize winner shall forfeit the prize and an alternative prize winner may be selected from the remaining Submissions according to the criteria provided above. Potential prize winners must comply with these Official Rules in order to be confirmed the winner of a prize. Potential prizewinners must sign and return any required forms, including, without limitation, affidavits of eligibility, prize acceptance and liability and publicity release forms, and IRS-W9 forms, to Sponsor five (5) days after delivery of the forms. If a potential prize winner fails to comply with these Official Rules or fails to return all of the required forms within the time specified, that potential prize winner may be disqualified, and an alternative prize winner may be selected by Sponsor from the remaining Submissions as set forth above. The return of the above-mentioned forms within the allotted time shall be the sole responsibility of the prizewinner; Sponsor is not responsible for delays in delivery.
GRANT OF RIGHTS
License. Submissions, in whole or in part, become the exclusive property of Sponsor and will not be returned. You unconditionally and irrevocably grant to Sponsor (and those acting pursuant to the direction of Sponsor) a perpetual, worldwide, royalty-free, irrevocable, fully-transferable license to use, display, screen, reproduce, communicate, or publish that Submission and to otherwise exploit the Submission (including, without limitation, footage, stills or tiles from the Submission and information from the Submission) for purposes of the Festival and for promotional purposes in any media or manner worldwide. Sponsor shall have no obligation to maintain any of the Submissions or information or ideas contained therein as confidential or proprietary. You agree that there is no guarantee that Sponsor will make use of any rights granted to Sponsor in any Submission and Sponsor shall have no obligation to use, publicly perform, transmit or screen the documentary, in any manner; any use of a Submission is solely at Sponsor’s discretion.
Rights of Privacy and Publicity of Others: By submitting a Submission, you represent and warrant that you have obtained written permission from each person whose name, image, likeness or voice (“Likeness”) is included in the Submission; that such person has granted you all necessary rights to use the person’s Likeness in the Submission and as described in these Official Rules; and that you can and will make written copies of such permissions available to Sponsor upon request. If the Likeness of a minor is included, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s Likeness on behalf of the minor. Sponsor shall not be responsible or liable for payment of any fees, residuals or other compensation to any individual appearing in a Submission who is a party to any agreement with any third party, or a member of any organization or union or guild. It is your responsibility to verify such possible relationships. Compliance with the rules of any trade union or guild that may have jurisdiction with respect to the Submission is your sole responsibility. Sponsor will not be held responsible or have any liability for any legal disputes regarding the exhibition of the Submission, including, without limitation, any disputes regarding compliance with the rules of any trade union or guild that may have jurisdiction with respect to the Submission.
Six (6) total prize(s) to be awarded.
One Finalist in each Category will be selected to receive the “Best in Category” prize by the judging panel as provided above. Each “Best in Category” winner will receive a prize valued at no less than $500.00. One Finalist will be selected as the overall Festival winner by the judging panel as provided above. The overall Festival prize is a $10,000 cash prize.
Sponsor makes no warranties, representations or guarantees relative to any prize, and disclaims all liability for the provision, use, quality or nature of any third party product or service provided to the prize winner. Prize winners are responsible for all taxes resulting from acceptance and use of the prize, and all costs and expenses not specified as part of the prize. Except for the prize values, prize winner will not receive any additional monetary compensation or acknowledgement for participation in the Contest, any advertisement or other material.
Prizes are non-transferable except by Sponsor and must be accepted as awarded. Prizes cannot be used in conjunction with any other promotion or offer. No substitution or cash equivalent of a prize is permitted except in Sponsor’s sole discretion; however, Sponsor reserves the right to substitute any prize with another of equal or greater value. No winner is entitled to the difference between the approximate retail value and the actual value of any prize. Sponsor is not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in the printing or posting of the offer or Official Rules, the selection and announcement of any winner, or the distribution of the prize. Any attempt to damage the content or operation of the Contest is unlawful and subject to legal action by Sponsor or its agents. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate or suspend this Contest if the Contest cannot be operated as planned or should virus, bugs or other causes beyond Sponsor’s control corrupt or impair the administration, security or proper play of this Contest. In such event, Sponsor reserves the right to void the entries at issue or cancel the Contest and select a winner from the eligible entries received up to the time of cancellation that have not been compromised. Sponsor will not replace any lost or stolen prize items. The Sponsor and any telephone network or service providers are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
LIMITATION OF LIABILITY, INDEMNIFICATION AND RELEASE
BY ENTERING THE CONTEST, YOU AGREE, on YOUR OWN behalf and ON BEHALF OF the OWNERS of the SUBMISSION (including individuals and any relevant production and distribution companies), and their successors and assigns, TO RELEASE, INDEMNIFY, REIMBURSE, DEFEND AND HOLD HARMLESS SPONSOR AND THE FESTIVAL, CONTEST ADMINISTRATORS AND THEIR RESPECTIVE PARENTS, AFFILIATES AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES AND AGENTS (“INDEMNIFIED PARTIES”) FROM ANY CLAIMS, ACTIONS, LIABILITY, COSTS, DAMAGES, LOSSES, PENALTIES, FINES, JUDGMENTS, INJURY, FEES AND EXPENSES OF ANY KIND INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES AND COSTS (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES) WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), CONTRACT, WARRANTY, STRICT LIABILITY, RELIANCE OR UNDER ANY OTHER THEORY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM (I) YOUR SUBMISSION, (II) ANY MATERIALS OR FOOTAGE CONTAINED THEREIN OR SUBMITTED BY YOU, (III) THE USE, PERFORMANCE OR SCREENING OF YOUR SUBMISSION AS PROVIDED HEREIN, (IV) ANY BREACH OF THESE OFFICIAL RULES BY YOU, AND (V) PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON, AND WHETHER OR NOT THE INDEMNIFIED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE INDEMNIFIED PARTIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE CONTEST WEBSITE AND ALL OTHER ELEMENTS OF THIS CONTEST IS AT YOUR OWN DISCRETION AND RISK. THE CONTEST WEBSITE AND ALL OTHER ELEMENTS OF THIS CONTEST ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. YOU UNDERSTAND THAT THE INDEMNIFIED PARTIES MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE RELIABILITY, TIMELINESS, AVAILABILITY AND/OR PERFORMANCE OF ANY ELEMENT OF THIS CONTEST. THE INDEMNIFIED PARTIES DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM OR LOSS OF DATA RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
You, on behalf of yourself and the owners of the Submission (including individuals and any relevant production and distribution companies), and their successors and assigns, hereby release and forever discharge the Indemnified Parties for (i) any damage to or loss of the film print, videotapes, or other materials to or from the Festival or during the course of the Festival’s possession of the Submission, or (ii) failure to screen the Submission, in whole or in part, for any reason whatsoever, including the negligent, grossly negligent, reckless or willful actions or inaction on the part of an Indemnified Party. You, on behalf of yourself and the owners of the documentary (including individuals and any relevant production and distribution companies), and their successors and assigns, expressly waive any and all rights and benefits conferred upon you/them by the provisions of §1542 of the California Civil Code, which reads as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER, MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
Any dispute or Claim arising out of or in relation to the Contest, or the interpretation, making, performance, breach or termination thereof, shall be finally settled by binding arbitration in Los Angeles, California, under the Commercial Arbitration Rules ("Rules") of the American Arbitration Association by three arbitrators appointed in accordance with the Rules, or by JAMS, Inc. or such other arbitration association as mutually agreed by the parties. Judgment on the award shall be final and may be entered in any court having jurisdiction thereof. CLASS ACTION WAIVER: Each Contest participant agrees that all Claims will be arbitrated on an individual basis and that there will be no class or representative actions in arbitration. Contest participants may not participate in a class or representative action against ArcLight as a class member if the class action asserts claims that would fall within the scope of this arbitration agreement if they were asserted directly by that Contest participant. Each Contest participant agrees that this class action waiver is an essential part of the arbitration agreement and that the class action waiver may not be severed from the arbitration agreement. If this class action waiver is found to be unenforceable by any court or arbitrator, then the entire arbitration agreement set forth herein will not apply to any Claim between a Contest participant and ArcLight. These Official Rules and participation in the Contest shall be governed by the laws of the State of California, excluding its conflicts of laws principles. The arbitration proceedings shall be governed by federal arbitration law and by the Rules or the rules of the applicable arbitration entity. Each Contest participant and ArcLight agree that, any provision of applicable law notwithstanding, neither party will request, and the arbitrators shall have no authority to award, punitive or exemplary damages against the other party. If any provision(s) of these Official Rules is held by the arbitrators to be unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. The failure to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision unless acknowledged and agreed to by ArcLight in writing.
PRIVACY, PUBLICITY AND USE OF INFORMATION
By participating, you grant Sponsor and its affiliates, permission to use your name, likeness, or comments for publicity purposes without payment of additional consideration, except where prohibited by law. Sponsor may engage certain third party companies to perform services in connection with the administration of this Contest and information provided by entrants may be collected and used by those third parties for purposes of administration of the Contest and the fulfillment and verification of prize awards.
The winners’ names may be requested by sending a self-addressed stamped envelope to: ArcLight, Attn: Documentary Festival, Contest Winner's List, 120 N. Robertson Blvd., Los Angeles, CA 90048. Requests must be postmarked by January 15, 2014.
