CINEFLIX FILM FESTIVAL RULES

1 RULES & REGULATIalONS FOR SUBMISSION
The following is an explanation of rules and regulations (“Rules and Regulations”) governing the submission of a film (hereafter called the “Film”) to Cineflix Festival (hereafter called the “Festival”) for consideration for the CINEFLIX FILM FESTIVAL (hereafter called the “Festival”). All information contained in this document shall supersede the contents of any prior document.

By agreeing to the Terms And Conditions found on the Festival submission form located at http://www.cineflixdod.com, the person submitting the Film (hereafter called the “Applicant”) acknowledges that he or she has obtained consent from any and all owners, creators, writers, Producers and/or other authorized representatives of the Film (hereafter called the “Film’s Owners”) whose consent is required to submit the Film to the Festival, and has read and understood the submission rules and regulations set forth below:

GENERAL RULES AND REGULATIONS FOR SUBMISSION OF A FILM TO THE CINEFLIX FILM FESTIVAL
NOTE: The submission categories and program categories that are referenced and identified as capitalized terms in this Section I of these Rules and Regulations, and the eligibility requirements for each, shall be understood as having the definitions and descriptions assigned to them in Sections II and III of these Rules and Regulations below.
1) If the Film’s final running time is projected to be less than 50 minutes, the Film may only be submitted as a Short Film.

2) If the Film’s final running time is projected to be 50 minutes or more, the Film may only be submitted as a Narrative or Documentary Feature Film.
3) Films that have been submitted for Festival consideration in previous years are eligible for re-submission for 2016 Festival consideration, but only if the Film has been changed significantly since the previous year in which it was submitted. The Festival shall have the sole authority and discretion to determine whether a Film that was previously submitted has been changed significantly from the previously submitted version. The Festival reserves the right to determine a previously submitted Film’s eligibility, without refund of any or all submission fees previously collected from the Applicant, based on the content of the newly submitted version of the film as compared with the previously submitted version.

4) It is the sole responsibility of the Applicant to secure authorization and permission from the copyright owner(s) of any and all copyrighted content or materials included within the submitted Film. The Festival expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any copyrighted content or materials within or relating to the submitted Film, including any content or materials that are or may become the basis for any third party claims for copyright infringement. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film with any unauthorized inclusion of copyrighted content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity that alleges that the Film makes unauthorized or unlawful use of any copyrighted content or material, Applicant shall fully indemnify and defend the Festival, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection therewith.

5) It is the sole responsibility of the Applicant to secure authorization and permission from the owner(s) of any and all trademarked content or materials included within the submitted Film. The Festival expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any trademarked content or materials within or relating to the submitted Film, including any content or materials that are or may become the basis for any third party claims for trademark infringement, trademark dilution or unfair competition. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film with any unauthorized inclusion of trademarked content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity that alleges that the Film makes unauthorized or unlawful use of any trademarked content or material, Applicant shall fully indemnify and defend the Festival, the Festival, and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to attorneys’ fees, that any of them may incur in connection therewith.

6) It is the sole responsibility of the Applicant to clear all content of the Film from any and all actual or potential legal claims and issues, including, without limitation, claims based upon theories of libel, defamation, invasion of privacy, violation of rights of publicity, theft of trade secrets, breach of confidence, breach of confidential relationship, and breach of express or implied contract (“Third Party Claim(s)”). The Festival expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any content or materials within or relating to the submitted Film that are or may be the basis for any Third Party Claims based upon any of the foregoing legal theories or others. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film that is or may become the subject of any Third Party Claims. In the event that any Third Party Claim(s) shall be asserted by any person or entity, Applicant shall fully indemnify and defend the Festival, the Festival, and each of their representatives and affiliates from any liability in connection therewith, and from any and all fees and expenses, including but not limited to attorneys’ fees, that each of any of them may incur in connection therewith.

7) Applicants submitting Films that contain significant non-English spoken dialogue must provide on-screen English subtitles. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film that contains significant non-English spoken dialogue that does not include accompanying on-screen English subtitles.

8) All Feature Films (50 minutes or longer) must be submitted to the Festival on a single disc (DVD-R, DVD+R, DVD-R DL, DVD+R DL, or Blu-ray) or uploaded via the Secure Online Screener function of Withoutabox. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from Applicant, any feature-length Film that is not submitted using one of these formats. If the Film is submitted in multiple parts on multiple discs, the Festival reserves the right to judge the Film based on the first disc included, with no further obligation to view the contents of the remaining discs.

9) All Short Films (less than 50 minutes in length) must be submitted to the Festival on a single disc (DVD-R, DVD+R, DVD-R DL, DVD+R DL) or uploaded via the Secure Online Screener function of Withoutabox. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Short Film that is not submitted using one of these formats. Short Films may not be submitted on Blu-ray disc. If multiple short films are included on a single disc, the Festival reserves the right to judge only the first film included on the disc, with no further obligation to view the remaining contents of the disc.

10) It is the sole responsibility of the Applicant to ensure that any submitted disc plays in its entirety on an industry standard DVD or Blu-ray player prior to submitting it to the Festival. In the event that a submitted disc does not play in an industry-standard standard DVD or Blu-ray player, the Festival will attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to obtain a replacement copy of the Film. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film for which the initially-submitted disc does not play on an industry-standard DVD or Blu-ray player. 4

11) It is the sole responsibility of the Applicant to ensure that the submitted disc arrives at the shipping destination provided to the Applicant upon completion of the submission form. In the event that a submitted disc does not arrive at the designated shipping destination within the deadline window selected by the Applicant, the Festival will attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to obtain a submission copy of the Film. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film that does not arrive at the designated shipping destination within the deadline window selected by the Applicant.

12) In the event that the Applicant remits an updated version of the Film to the Festival after having submitted a previous version of the Film to the Festival during the same calendar year, the Festival is under no obligation to view any or all of the updated version.

13) In order to be considered for the Festival, the Applicant must fill out the Festival submission form located at http://www.cineflixdod.com. The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film that is not submitted through one of these platforms.

14) The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Film with a submission form that is considered to be delinquent due to the non-payment of any or all submission fees. The Festival may attempt, but is under no obligation, to contact the Applicant using the contact information provided on the submission form in an effort to bring the payment status of the account up-to-date. The Festival disavows any responsibility for, and will not be held responsible for, any failure to contact the Applicant and inform the Applicant of any payment delinquency or other deficiency of a submission form.

15) The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Feature Film (50 minutes or longer) received before May 1 or after September 29.

16) The Festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the Applicant, any Short Film (less than 50 minutes in length) received before May 1 or after September 15.

17) Upon completion of the Festival selection process, the Festival will attempt to contact the Applicant using the contact information provided on the submission form to notify the Applicant of the Film’s acceptance status. The Festival disavows any responsibility for, and will not be held responsible for, any failure to contact the Applicant using the contact information provided on the submission form. It is the sole responsibility of the Applicant to ensure that the contact information provided on the submission form is correct throughout the entirety of the Festival selection period.

18) The Festival is under no obligation to provide to the Applicant or any other representative of the Film any comments or feedback regarding the submitted Film, any information relating to the manner in which the Film is, will be, or was reviewed; any views that the Festival or any reviewers of the Film may hold concerning the Film; any reasons why the Film, should it not be accepted for exhibition at the Festival, was not accepted; or any other information relating to the Festival’s review, consideration and/or selection process regarding the Film specifically or submissions generally beyond the information set forth in these Rules and Regulations. The Festival disavows any responsibility for, and will not be held responsible or liable for, the contents of any internal comments or feedback regarding any Film that are or may be obtained by the Applicant or any other representative of the Film; any communications by any representative of the Festival or the Festival relating to the Film or the Festival selection process; the manner in which the Film shall be, is or was considered and reviewed; the identity or identities of any specific reviewers of the Film; and/or any failure on the part of the Festival or the Festival to provide the Applicant or any other representative(s) of the Film with information concerning the Festival’s consideration and/or review of the Film.

19) Films accepted by the Festival into the Festival agree to be placed in a "Digital On Demand" distribution package and the 8-city festival tour over 8-weeks, at the sole and absolute discretion of the Festival Programming department. Filmmakers who decline the distribution or the festival tour will be disqualified from the competition.

SUBMISSION CATEGORIES & ELIGIBILITY REQUIREMENTS
Films submitted to the Festival for consideration for the Festival may apply in any submission categories. The Festival reserves the right to determine eligibility of any film for any Festival program or submission category.

Films that have distribution are not eligible for any of the Festival’s Festival programs.

Short Films have no premiere requirements or prior screening restrictions-- they may have had any number of public exhibitions, and been released via any home video or distribution platform, and may have been broadcast on television or the internet and still retain eligibility.

FESTIVAL PROGRAM CATEGORIES & ELIGIBILITY REQUIREMENTS

The Festival disavows any responsibility for, and will not be held responsible or liable for, the contents of any internal comments or feedback regarding any Film that are or may be obtained by the Applicant or any other representative of the Film; any communications by any representative of the Festival or the Festival relating to the Film or the Festival selection process; the manner in which the Film shall be, is or was considered and reviewed; the identity or identities of any specific reviewers of the Film; and/or any failure on the part of the Festival or the Festival to provide the Applicant or any other representative(s) of the Film with information concerning the Festival’s consideration and/or review of the Film.

TERMS AND CONDITIONS

First and foremost, submitting your film to the CineFlix Film Festival (CFF) in no way implies any ownership rights by CFF to the submitted film. You own your project. If you are approached by anyone to option your film as a result of being listed on our website or being screened at CFF, we do not take a cut of the deal. It is your film and all rights remain yours. If you have any questions, please do not hesitate to ask. Our door is always open to our filmmakers.

You can submit your film online. We do not select our films based on the packaging. CFF does accept films that are Works-In-Progress. Only one film per application. If entering more than one movie, you must submit each separately. Each project is judged solely on its merits.
To be eligible to screen, your film does not have to be a World Premiere or a USA Premiere. Films can be original or adapted works. However, ALL non-original portions of your film MUST be cleared and You must have permission to use someone else's work. If you submit a film with copyrighted or trademarked materials included and you do not have written permission to use them, you will not be eligible to screen at CFF. We have no interest in getting sued. So, you must be legally authorized to represent the entire work, in writing. Also, you should copyright your film with the proper agency (in the USA, its the Library of Congress). It is not required for screening at CFF, but it is smart on your part to protect your work.

All production formats are eligible. Your film needs to be in English, or subtitled or dubbed in English. Your film cannot currently be in distribution. Film selections and award nominees will be posted on the CFF website approximately one month before the festival.
Each project is judged solely on its merits.

Selected films will receive a distribution contract and an 8-city theatrical tour. If the filmmaker opts out of either, they will be disqualified from the competition.

Please clearly label ALL submitted materials with AT LEAST the title of the work. CFF does not return submitted materials, so please do not send us your master copies. Also, CFF cannot grant waivers for fees or deadlines. Please do not ask.

ALL of your submission entry items (entry fee, copy of your Film, application form) must be comleted by the deadline date that you are trying to submit by, in order to qualify for that deadline date. CFF does not screen anything that we feel promotes hardcore pornography, real-life cruelty to humans or animals, or hate.

You hereby grant CFF the right to utilize any excerpt from your submitted film for promotional purposes. The individual or company submitting the film hereby warrants that it is authorized to commit the film for screening, and understands and accepts these requirements and regulations. By submitting your film to this competition you agree that, if your film is selected by CFF, You grant to CFF a NON-exclusive license to use, display, exploit and exhibit Your name, trade names, trademarks, service marks, copyrights, still images, moving images, audio sounds, your submitted film, material, information, and/or any other things received by CFF, whether by physical or electronic delivery (including material and/or material(s) here, and above and below herein), publicly, at CFF's sole discretion to promote, market and advertise the festival. CFF may also use excerpts from trailers of submitted films for promotion, to promote, market and advertise the festival. You also authorize CFF to place your images and synopsis on our website, and films are reviewed by CFF with the intention of selecting screeners for the festival and the work will not be divulged to any persons not affiliated with CFF unless first permitted in writing by a legally authorized representative of the work.

The individual or company submitting the film shall indemnify and hold harmless the Festival from and against any and all claims, liabilities, losses, damages, and expenses (including but not limited to attorney's fees, and costs of the court) which may be incurred by reason of any claim involving copyright, trademark, credits, publicity, screening, and loss of or damage to the screening items entered. The individual or company submitting the film hereby warrants that it is authorized to commit the film for screening, and understands and accepts these requirements and regulations.

Non-performance of any party shall be excused to the extent that performance is rendered impossible by strike, fire, flood, earthquakes, war, governmental acts or orders or restrictions, acts of God, physically defective product/equipment, or any other reason where failure to perform is beyond reasonable control of, and not caused by the negligence of, the non-performing party.

Neither party shall owe any liability to the other party arising under this agreement for any indirect, special, punitive or consequential damages, including, without limitation, loss of profit or business opportunities, except as expressly set forth herein. Neither party makes (and each party hereby specifically disclaims) any, representations or warranties, express or implied, regarding the services contemplated by this agreement, including any implied warranty of merchantability or fitness for a particular purpose, implied warranties arising from a course of dealing or course of performance or any warranties relating to title or non-infringement of intellectual property. Neither party makes any representation, warranty or assurance concerning any minimum or maximum number of viewers or screenings or celebrities or special guests or events.

Except for payments due collected by CFF as stated herein or on CFF website(s), CFF liability for any damages caused to You as a result of performance or non-performance or damage under, or not under, this agreement shall be limited in all circumstances to an amount no greater than one U.S. dollar ($1.00).

Acts of God do happen. In any situation, if anything, negative or unwanted happens involving CFF, CFF will not be expected by You to be liable or responsible for the damage in anyway whatsoever, regardless of how severe the damage. Further, CFF will not be expected by You to be liable or responsible in anyway whatsoever should CFF or the CFF website not be accessible. Furthermore, CFF will not be expected by You to be liable or responsible in anyway whatsoever for any items that are stolen while either in, or not in, the possession of CFF, in perpetuity.

By entering CFF, all entrants agree to the complete contents of the CFF rules and policies found on the official CFF website at www.CineFlixFest.com. All entrants release and agree to hold CFF and/or all other CFF related entities harmless from and against any and all injuries, rights, damages, losses, claims and actions of any kind arising in whole or in part, directly or indirectly, from CFF or participation in CFF and any CFF related activity, in perpetuity. All entrants release and waive any claims with regard to CFF and agree to hold harmless CFF and/or all CFF related entities from and against any and all claims of any kind that are or could be asserted with respect to any festival related matter whatsoever, in perpetuity. All entrants further agree to indemnify, defend against and agree to hold harmless CFF and/or all other CFF related entities from any and all liabilities, damage, costs and/or fees incurred in defending against any third party claim(s) or threat(s) of claim(s) asserted against CFF and/or all other CFF related entities arising from any entrant(s) participation in or conduct associated with CFF, in perpetuity.
All CFF rules and policies are governed by and shall be construed in accordance with the laws of the Louisiana, United States of America, without regards to its principles of conflicts of law, in perpetuity. For any dispute not subject to arbitration, entrant agrees to personal jurisdiction by the federal and state courts located in Pennsylvania, United States of America, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby irrevocably waives all rights to claim, punitive, incidental, or consequential damages, and/or any other damages, including attorney fees, other than participant(s) actual out-of-pocket expenses (i.e.- costs associated with participating in the festival competition), and entrant further irrevocably waives all rights to have damages multiplied or increased, in perpetuity. All federal, state, and local laws and regulations apply. All taxes on or connected with any prize and the reporting consequences thereof, are the sole and exclusive responsibility of respective winners.
All information by CFF, whether publicly posted or not, is subject to change without prior notice. All festival and screening decisions will be made by the CineFlix Film Festival (CFF) and all CFF decisions are final.
