MISSION & OBJECTIVE
The Florida Media Market (FMM) is an organization whose goal is to build a platform where independent film & media makers meet with international buyers, distributors and production companies to buy, sell and network. We've created an annual market for film, documentary, television and media deal-making that will fortify our industry both in Florida and internationally. FMM's 7th annual event: Connecting the Multiplatform Conference will take place in Miami, FL January 22, 2014- January 26, 2014 at the Miami Beach Resort and Spa in Miami Beach.

ABOUT THE FESTIVAL
Florida is the bridge to all media cultures of Hollywood, Europe, Asia, and Latin America. For this reason, the Florida Media Market (FMM) was created as an annual market for film, documentary, television and media deal making, which aims to fortify the industry both in Florida and internationally. The idea of FMM first emerged in 2006. The FMM is not only a live platform, but also an online resource that allows independent filmmakers to pitch their ideas and meet buyers, distributors, and production companies allowing them to negotiate their content in a virtual way with executives. Our passion is the craft of good storytelling that is compelling and entertaining which creates better entertainment for a better world.

Your Sizzling Pitch entry to be considered by our jurors should be composed of these three parts:
a) Must include a synopsis, character description, and if applicable, a script.
b) Include this media kit:
Intentions: of the creator, director, producer and/or any other author attached to the project [120 words each]
Transmedia Dimension of the project (what platforms your project aims for) [120 words]
Financial Model: [120 words]
Estimated Budget: (in US dollars)
Main needs and challenges you are facing at this stage of the project [3 entries, 60 words each]
Team: who you are and who you are looking for to collaborate with (120 words)

• No full commercial or long commercial blacks.
• No burned-in time codes.
• Avoid copyright disclaimers beyond the start of the trailer.

• Fees Payment is online, by credit card, following the indications described on the entry form.
• An additional $30 administrative fee will be charged to both early bird and final entries when candidate will wish to pay by check, bank draft, or wire transfer.

TERMS AND CONDITIONS

Terms and conditions This submission release agreement (the “Agreement”) is made and shall become effective as of the above referenced date (the “Effective Date”), by and between The Florida Media Market (FMM) on the one hand, and You (Filmmaker), on the other hand. This Agreement also limits certain causes of action you may assert against the entertainment industry [Judges] with whom you meet and share your ideas, incident to your participation in the 2014 event (hereinafter “Event”) taking place in Miami, FL between September 24 through September 28th. 1. In connection with the Event, I, the Filmmaker, am submitting to the industry Judges and FMM a herewith the following described material, ideas, suggestions, themes, plots, stories, characters, dialogue, titles or creative work, whether in writing or other format, (hereinafter referred to as Sizzling Pitch or the Ready for Distribution Project). 2. Filmmaker acknowledges and hereby agrees that FMM is not reviewing, editing, retaining or providing feedback on the Sizzling Pitch or Ready for distribution Project, and that FMM’s role in the Event is simply as an intermediary to facilitate meetings between the Filmmaker and the Judge. However, FMM may be required to conduct a cursory review of the Sizzling Pitch or Ready for Distribution Project for logistical/categorization purposes only. FMM will not edit, review, retain or otherwise distribute the Sizzling Pitch or Ready for Distribution Project without the express written consent of the Filmmaker, and, if different, the rights holder of the Sizzling Pitch or Ready for Distribution Project. 3. Filmmaker understands that the Judges do not purchase literary properties, and that Judge has adopted the policy of refusing to accept, consider or evaluate unsolicited literary (including, but not limited to, digital and audiovisual) material for the Event, unless the submitting party of such material has signed an agreement in form substantially the same as the Agreement. Filmmakers further acknowledge that the Judges would refuse to accept, consider, evaluate or otherwise include any material in the Event in the absence of Filmmaker’s acceptance of each and all of the provisions of this Agreement. Filmmaker also understands that no confidential or fiduciary relationship now exists with Judges, and that no such relationship is established by Filmmaker’s submission of the Sizzling Pitch or Ready for distribution Project to Judges under this Agreement or otherwise. Thus, Filmmaker shall retain and hereby reserves all rights to submit the Sizzling Pitch or Ready for distribution Project, or similar material, to persons and entities other than the Judges. 4. Filmmaker recognizes that FMM, including its officers, directors, employees, agents, representatives, members and conference attendees, including Judges, have access to, and/or may create or have created literary materials and ideas which may be similar or identical to the Sizzling Pitch or Ready for Distribution Project in theme, idea, plot, format or other respects. Filmmaker agrees that he/she will not be entitled to any compensation, and may not pursue any action, in law or in equity, incident to the use of any such similar or identical material, which may have been independently created or developed by FMM and/or executive. 5. FMM will not indemnify Judges for claims Filmmakers may bring against Judges. 6. Filmmaker agrees that no obligation or duty of any kind is assumed or may be implied against FMM or the Judges by reason of executive’s review of the Sizzling Pitch or Ready for distribution Project. Filmmaker acknowledges that he/she will be pitching the Sizzling Pitch or Ready for distribution Project in a public forum, and that an audience member, or other party present at the Event, may inadvertently or intentionally make an unauthorized use of the same, and that neither FMM nor the Judges have assumed any obligation or duty of any kind with respect to the actions of such audience members or other present parties at the Event. 7. Both FMM and the Judge may use, without any obligation or payment to Filmmaker, any non-protected elements of the Sizzling Pitch or Ready for Distribution Project pursuant to copyright law (or other applicable laws). This includes, but is not limited to, ideas not fixed in tangible mediums of expression, historical, factual or other public domain elements and aspects of the Sizzling Pitch or Ready for distribution Project, which a third party would be free to use if such third party received the Sizzling Pitch or Ready for Distribution Project from a lawful source. Any use of said material, in accordance with the proceeding section, shall be defined as unprotected material. The foregoing shall apply whether or not you have obtained such ideas and/or other public domain elements from other sources. 8. Notwithstanding anything to the contrary contained herein, nothing in this Agreement constitutes a waiver, by the Filmmaker, of any of Filmmaker’s legal rights, remedies, or recourse against Judges in the event that Judges compromises, uses, misappropriates, or in any way infringes upon the legally protected portions of filmmaker’s Sizzling Pitch or Ready for Distribution Project. In such instance, Filmmaker may pursue any legal rights, remedies or recourse to seek compensation and restitution under the Copyright Act of 1976, and any other federal, state, local, or common law that applies. In such instance, Filmmaker acknowledges that FMM functions simply as a forum of lawful idea exchange and is not liable for any compromise, use, misappropriation, or any infringement by the Judge, and Filmmaker agrees to defend and hold FMM harmless in any civil suit that ensues from such misuse. 9. ARBITRATION. Any and all disputes that arise with respect to this Agreement and concerning this Agreement, including the scope or applicability of this consent to arbitrate, shall be determined by binding arbitration. Each party hereby waives any and all rights and benefits that it might otherwise have or be entitled to under Florida law to litigate any such dispute in court, it being the intention of the parties to arbitrate, according to the provisions herein, all such disputes. Either party may commence arbitration proceedings by giving the other party adequate written notice thereof. The parties hereto agree to an expedited arbitration process before the American Arbitration Association and pursuant to its rules. Arbitration proceedings shall be presided over by a mutually selected and agreed upon arbitrator, who shall be a person experienced and knowledgeable in the entertainment industry and intellectual property law. The arbitration shall be conducted in the County of Miami, State of Florida, and except as herein expressly provided otherwise, the arbitration shall be governed by and subject to the laws of the State of Florida and the then prevailing rules of the American Arbitration Association. The arbitrator’s decision shall be controlled by the terms of this Agreement. 10. Except as otherwise provided in the Agreement, the filmmaker hereby releases FMM and Judges of and from any and all losses, claims, demands, liabilities and expenses (including reasonable attorney’s fees and costs) of every kind whatsoever, known or unknown, that may arise in relation to the Sizzling Pitch or Ready for Distribution Project, or by reason of any claim now or hereafter made by Filmmaker that FMM or Executive have used or appropriated the Sizzling Pitch or Ready for Distribution Project, except for fraud or willful injury. 11. Either party to this agreement may assign or license to any person, firm or corporation, its rights hereunder. Such assignment or license, however, shall not relieve such party of its obligations hereunder. This agreement shall inure to the benefit of the parties hereto and their respective heirs, successors, representatives, assigns, and licensees. 12. Filmmaker has retained at least one copy of the Sizzling Pitch or Ready for Distribution Project Materials, and the Judge is not obligated to return said material to Filmmaker. Accordingly, the Filmmaker hereby releases the Judge of any and all liability for loss of, or damage to, the copies of the Sizzling Pitch or Ready for Distribution Material submitted to Executive herewith. No Sizzling Pitch or Ready for Distribution Material(s) have been submitted to FMM. 13. Filmmaker agrees to permit FMM to follow up with him/her periodically to track Filmmaker’s progress in relation to attending the Event. 14. Filmmaker has read and understands the Agreement and that no oral representations of any kind have been made to Filmmaker, and that this agreement states the entire understanding of the Filmmaker with respect to his/her participation in the Event, and any Sizzling Pitch or Ready for Distribution Material (including any association documents thereto) submitted incident to his/her participation in said Event. Filmmaker further agrees that no other obligation exists or shall exist, or be deemed to exist, unless and until a formal written agreement has been prepared and entered into by Filmmaker and Judge. Any modification or waiver of any of the provisions of this agreement must be in writing and signed by both Filmmaker and FMM. 15. Filmmaker understands that while FMM makes every effort to ensure the continued participation of confirmed participating Judges, occasionally Judges will cancel and FMM makes no guarantee as to the continued participation of confirmed Judges. 16. If any provision of the Agreement or part thereof is held to be invalid, unenforceable or contrary to public policy, then the remainder of this Agreement shall remain valid and fully enforceable.
